On 21 July 2017, the Philippine Tobacco Institute (PTI), a trade association of cigarette manufacturers in the Philippines filed a petition for prohibition against Balanga City on the grounds of pre-emption, alleging prohibitions delineated in the Comprehensive No-Smoking Ordinance - CNSO (prohibiting sales and use within a 3km radius of the city's university town) supersede and therefore violate national regulations established by the Tobacco Regulation Act of 2003
